Terms & Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern your use of the services and website provided by Coolhost (“we”, “us”, or “our”), a South African web hosting provider. By registering, accessing, or using any of our services, including the Client Area hosted at https://my.coolhost.co.za, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 18 years old or have the legal capacity to enter into a binding agreement under South African law. By using our services, you represent and warrant that you meet this requirement.

3. Services Provided

Coolhost provides the following services:

  • Shared and dedicated web hosting
  • Domain name registration and management
  • Email hosting and email security
  • VPN services
  • SSL certificates and other digital services

All services are subject to availability, and we reserve the right to modify, discontinue, or suspend any service at our discretion.

4. Account Registration & Security

  • Users are required to create an account via the Client Dashboard.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify us immediately of any unauthorized use of your account.
  • Coolhost is not liable for any loss or damage resulting from your failure to comply with this obligation.

5. Billing and Payment

  • All services are billed in South African Rand (ZAR).
  • Payment methods accepted include EFT, credit/debit cards, and other payment gateways as listed on our billing page.
  • Hosting services are billed on a recurring basis (monthly or annually), depending on your selection.
  • Failure to pay invoices by the due date may result in service suspension or termination.
  • Domains are not registered or renewed until full payment is received.
  • Refunds are granted solely at our discretion and are subject to our refund policy.

6. Domain Name Registration

  • Domain registrations are subject to availability and the rules of the respective registries (e.g. ZACR for .co.za domains).
  • You are responsible for ensuring that domain information is accurate and up to date.
  • Failure to renew your domain on time may result in its expiration or loss.

7. Acceptable Use Policy (AUP)

You agree not to use our services to:

  • Host or distribute any unlawful, defamatory, obscene, or harmful content.
  • Engage in spamming, phishing, or malware distribution.
  • Infringe on the intellectual property rights of others.
  • Interfere with or disrupt network services or security.
  • Use excessive system resources in a way that affects other clients (“resource abuse”).

We reserve the right to suspend or terminate accounts found in violation of this AUP without prior notice.

8. Data and Content Ownership

  • You retain ownership of all content and data uploaded to your hosting account.
  • You grant Coolhost a license to store, back up, and transmit your data as necessary to provide the service.
  • You are responsible for ensuring that all content complies with applicable laws and regulations.

9. Backups and Data Loss

  • While we may offer routine backups, clients are solely responsible for maintaining up-to-date backups of their data.
  • Coolhost shall not be held liable for any data loss, corruption, or failure to restore data.

10. Client Area Access (coolhost.co.za/login)

  • The Client Area is provided for service management, billing, support ticketing, and domain registration.
  • Unauthorized access or attempted breach of the Client Area is strictly prohibited and may result in legal action.
  • Activities within the Client Area are logged for security and auditing purposes.

11. Service Level Agreement (SLA)

  • Coolhost strives to maintain a 99.9% uptime across all hosting services.
  • SLA exclusions include scheduled maintenance, third-party issues, and force majeure events.
  • In the event of a service outage, credits may be issued at our discretion and upon request.

12. Suspension & Termination

We reserve the right to suspend or terminate your account without notice for:

  • Violation of these Terms or our AUP
  • Failure to pay for services
  • Security or legal concerns
  • Activities deemed harmful to Coolhost or its infrastructure

Upon termination, all data, services, and access may be permanently deleted.

13. Limitation of Liability

To the fullest extent permitted by South African law:

  • Coolhost shall not be liable for any indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount paid by you in the last 3 months of service.

14. Indemnification

You agree to indemnify and hold harmless Coolhost, its employees, and partners against any claim, liability, damage, or expense arising from your use of the services or violation of these Terms.

15. Privacy and Data Protection

We process personal information in accordance with the Protection of Personal Information Act (POPIA) and our Privacy Policy. You consent to such processing by using our services.

16. Changes to Terms

Coolhost may update these Terms at any time. Continued use of our services after changes constitutes acceptance. It is your responsibility to check this page periodically for updates.

17. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted under the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
